People may not find it an alarming and serious issue since the danger at the present time is negligible but sooner or later we will come to realize that we really are into serious danger. Global issues are global concerns. It is felt around the world not just on a particular location. It is a world wide issue that needs to be address. There are many types and forms of current global issues that the world has to face. There is the economic crisis felt all over the world. Various health issues that came out as more people get vulnerable to cancer and other forms of illnesses. There is terrorism which is a crisis in peace and order and security. There is also issue on moral degradation of the society. Lastly is the global warming or global climatic change. Even though some believe global warming to be a hoax, severe weather repercussions and environmental crisis prove the opposite. This global warming is an alarming environmental problem on a global scale. Some people still have doubts if the global warming issue is real or is just an imaginary anxiety fabricated by scientist who has predicted it as a serious problem in the near future. There was hundreds of information released about the onset of global warming. Many people have made research and studies to investigate these phenomena. Documentaries are produce to open the minds and inform the public regarding the new findings regarding the problem. A personal observation on our environment and a closer study will help one to discover and learn more about the development regarding the current issue on global warming. Big Picture of the Environmental Crisis Global warming, what does it really mean? What causes global warming? What factors contribute to this problem? And what are the effects of global warming? All of these are the questions frequently asked regarding this global environmental issue. Global warming is commonly known as the warming of the planet cause by the greenhouse gases that trapped the heat. Global warming is also known as global climatic change or global climatic disruption. Global warming resulted from the increase in heat-trapping gases in the atmosphere that causes the amplified hydrological cycle resulting in increased precipitation and flooding in some regions and more severe aridity in other areas. (Woods Hole Research Center, 2008) The phrase â€Å"climatic change† is preferred recently to be use than global warming because it helps convey that there are other changes aside from rising temperatures. Global warming involves the average increase in temperature of the atmosphere near the earth’s surface and in the troposphere, which can contribute in global climate patterns. Global warming and climatic change can be caused by a variety of factors, both natural and human-induced. (Environmental Protection Agency, 2008) Ozone layer depletion is oftentimes confused with global warming. Climate change and ozone depletion are different from one another but interrelated issues. Ozone depletion is not the principal cause of climate change and climate change is not the principal cause of ozone depletion. However, ozone depleting gases- such as chlorofluorocarbons (CFCs), hydrochlorofluorocarbons (HCFCs) and halons are greenhouse gases that do contribute to climate change. Ozone itself is a greenhouse gas that has effect on climate. In addition, certain changes in earth’s climate could affect the future condition of the ozone layer. For example, low temperature and strong polar winds both affect the extent and severity of winter polar ozone depletion. (EPA, 2008) The greenhouse effect is a natural phenomenon that helps regulate the earth’s temperature. Greenhouse gases (e. g. , carbon dioxide, methane, nitrous oxide, chlorofluorocarbons) act like insulating blanket, trapping solar energy that would otherwise escape into space. Without this natural greenhouse effect temperatures would be about 60oF lower than they are now and life as we all know it today would not be possible. However human activities, primarily the burning of fossil fuels and clearing of forest and industrialization have enhance the natural greenhouse effect, causing the earth’s average temperature to rise. (EPA, 2008) The greenhouse effect was first describes in theoretical terms by a Swedish researcher, Svante Arrhenius, in the late 1800s. However it wasn’t until the following century that Arrhenius’ theory was observed. In the 1930s, scientist realized that parts of the globe had warmed during the previous half-century. Then in early 1960s scientist discovered that the level of carbon dioxide in the atmosphere was rising. Researchers began to take interest and found a strong relationship in between the increasing carbon dioxide and average global temperature. (EPA, 2008) Human-induced global climatic change is under way. The IPCC (Intergovernmental Panel on Climate Change) concluded that global mean surface air temperature has increased between about 0. 5 and 1. 1 degrees Fahrenheit in the last 100 years and anticipates a further continuing rise of 1. 8 to 6. 3 degrees Fahrenheit during the next century. Sea-level has risen on average 4-10 inches during the past 100 years and is expected to rise another 6 inches to 3 feet by 2100. (WHRC, 2008) Charts and graphs showed alarming trends. Atmospheric carbon dioxide concentration has increase steadily over the past few years. The increase in the temperature is observed as well as the increase of the sea level. More disturbances in climate patterns have been greater in the previous years. These are environmental changes brought by this problem on global warming. Being Environmentally Conscious What are the ways to be conscious and aware of our impact on earth? People have to find ways or alternative energy resources. In the US for example the energy related activities account for over three quarters of human generated greenhouse emission, mostly in the form of carbon dioxide emissions from burning fossil fuels. Enhanced energy efficiency is found to be one of the cheapest, most effective and safest ways to reduce global warming. Buildings should practice energy efficiency. Cutting the fuel cost on the road by effective gas mileage will also help. Making home appliances more energy efficient will significantly lessen energy consumption. (wecansolveit. org, 2008) Adoption of renewable resources will help break the addiction to fossil fuels like coal and oil by switching to renewable energy. These include wind power, solar thermal, solar photovoltaics and geothermal power. (wecansolveit. org, 2008) Campaigns like â€Å"Zero Waste for Zero Warming† should also be supported. Landfills were found to be the largest source of methane (CH4) in the US, a global warming gas 23 times more powerful than CO2. Toxic dumps, landfills and incinerators must not be tolerated. People should learn to recycle and avoid littering. We can also use cloth bags as shopping bags to minimize waste. We need to promote green homes and businesses therefore taking monitor of our own carbon footprint. (Global Day Action, 2007) The Outcome If We Don’t Change Things: Who and What Will Be Affected? Severe weather changes will be the outcome if global warming will not be resolve early. These includes climatic change that will contribute to more destructive hurricanes and floods like Katrina, Gustav and Ike that cost millions of damages to property and life. Severe droughts will be experience in other parts of the world, deadly heat waves, wildfires and ocean temperatures rising. It will also affect the precipitation by increasing about 5 percent in atmospheric water vapor over the oceans increasing the risk of heavy rain and snow events. Scientist also predicted that the global average sea level will rise by 7 to 24 inches by 2100 due to thermal expansion alone. Arctic’s average temperature increases are nearly twice that of the rest of the world. The arctic sea ice could virtually disappear during the summer of 2020. Melting of permafrost will continue. This permafrost is ice that has permanently frozen into the ground. The permafrost traps methane and when the melting continues it will release more of it into the atmosphere. Melting due to climate change is expected to reduce the size and extent of the polar ice caps, even taking to account the potential of more snow and ice accumulation atop the ice sheets due to increased precipitation. Temperature changes in the Arctic Circle also cause polar bears to die. Also temperatures below oceans caused destruction of coral reefs. Ecosystems will also be affected because of floods and drought could lead to the risk of extinction for some animals and plant species. Agriculture and farming will also be affected due to weather extremes. Human health will also be greatly affected which will result in increases cases of malaria and dengue outbreak. Heat-related illness and cold related illness will increase. (EPA, 2008). Sandra Steingraber the author of Living Downstream also mentioned that the increase in cancer cases is attributed to environmental influences. The US Climate Policy The United States Federal Government has established a comprehensive policy to address climate change. This policy has three basic objectives namely: slowing the growth of emissions, strengthening science, technology and institutions and enhancing international cooperation. The federal government is implementing this policy through voluntary and incentive based programs and has established major government-wide programs to advance climate technologies and improve climate science. (EPA, 2008) Some of these policies include the national goal to reduce emissions intensity, current and near tem greenhouse gas reduction initiatives, climate change technology program, climate change science program and international cooperation like the IPCC and the Asia Pacific Partnership on Ocean Development and Climate. Action on global warming by cities and local government includes building codes, zoning, transportation systems and electricity production campaigns. These include local regulation requiring newly constructed homes to be more energy efficient, a city or local subsidy to encourage homeowners to install electricity generating solar panels, local regulations requiring electric utilities to produce at least 20% of their electricity from wind, solar, or other renewable energy sources. , changing the city’s or town’s zoning rules to require neighborhoods have a mix of housing, offices, industry, schools and stores close together to encourage walking and decrease the need for using cars among other regulations or local climate change policies. (American Support for Local Action on Global Warming) Conclusion Global warming is a real problem of our times. Some are skeptics and believe it is just a kind of â€Å"hysteria† by some scientists. Even if Al Gore emphasized global warming in his documentary film â€Å"The Inconvenient Truth† many still have doubts if it is real. Nature or what we call â€Å"mother earth† like humans need to be taken care of. It is our responsibility to manage our earth’s natural resources and to preserve our planet making it a livable place. If people will continue to abuse the environment and become careless in throwing toxic waste and emitting toxic gases our planet will eventually come to destruction someday. The predictions may not be far from real for us at the moment but it doesn’t mean we should neglect our responsibility in protecting our environment. There is still time for people to reduce the outcome of this event. People should start thinking seriously on how they can contribute in solving and altering the increasing scenario of global warming. Services Marketing A service is the action of doing something for someone or something. It is largely intangible (i.e. not material). A product is tangible (i.e. material) since you can touch it and own it. A service tends to be an experience that is consumed at the point where it is purchased, and cannot be owned since is quickly perishes. So often marketers talk about the nature of a service as: Inseparable - from the point where it is consumed, and from the provider of the service. For example, motor insurance may have a certificate, but the financial service itself cannot be touched i.e. it is intangible. Variability - since the human involvement of service provision means that no two services will be completely identical. For example, returning to the same garage time and time again for a service on your car might see different levels of customer satisfaction, or speediness of work. Right of ownership - is not taken to the service, since you merely experience it. For example, an engineer may service your air-conditioning, but you do not own the service, the engineer or his equipment. You cannot sell it on once it has been consumed, and do not take ownership of it. Western economies have seen deterioration in their traditional manufacturing industries, and a growth in their service economies. Therefore the marketing mix has seen an extension and adaptation into the extended marketing mix for services, also known as the 7P's – physical evidence, process and people. Physical evidence is the material part of a service. Strictly speaking there are no physical attributes to a service, so a consumer tends to rely on material cues. Service Many products, services and experiences are supported by customer services teams. The way in which a complaint is handled can mean the difference between retaining or losing a customer, or improving or ruining a company's reputation. Customer services can add value by offering customers technical support and expertise and advice. Controversial novels Essay

Argued to be one of Hardy’s most controversial novels, published in 1891 during an era when the underprivileged classes of society, were submissive to superstitious beliefs in particular those such as luck spiritual beings and ultimately fate which were the foundations of lower class civilisation, Tess of the D’Urbervilles presents a story of Fate toying with the life of the Heroine Tess. Fate is an influential part of the plot because it is what dictates her life. Events in the beginning of the novel begin a domino effect that cannot be reverse, thus Her fate is already chosen and all she can do is live through the events that happen to her. Whilst Walkers Colour purple is written during an era of gender social and racial inequalities narrated through Celie whose life consisting of an abundance of obstacles refuses to give into the Fate which determined the lives of poor uneducated black females during the 1930s. What exactly is Fate, is it in our personalities, actions and character or are our lives controlled by a supposed force or power which predetermines events in our life’s, meaning regardless of what we do we are unable to change our destiny. This theme is explored thoroughly by Thomas Hardy through his heroine Tess who is portrayed as a victim of fate throughout the novel, chance and coincidence bring about disasters in the novel that we can claim occur due to fate, it appears the main characters are subject to forces beyond their control. The author employs a very fatalistic plot throughout the novel making Tess endure whatever is thrown at her . In the first chapter of the book the horse Prince dies, this is seen as Tess’ fault as she falls as sleep due to being exhausted, this happens at night when the weather is very depressed. Hardy uses pathetic fallacy by claiming the ‘atmosphere’ was pale, this makes the reader feel tension and also an expectation of tragedy . This scene is similar to that of the one at the chase when Alec finds Tess unconscious and may have raped her which is ultimately up to speculation. It is clear that Hardy uses the death of prince to create a sense of foreboding as this episode and the one at the chase are extremely similar, on both occasions Tess has fallen asleep due to tiredness and also the weather is used as an indication for what is to follow. From this we can question whether these events are down to fate and also ask if Hardy pre-determines Tess’ fate and future through her early actions thus her future is unalterable so there is nothing she can do to change. This has lead to the critic The Irvine Howe has writing: ‘May we see her purely as a victim, like the white horse, the pheasants, the animals who are killed at harvest time? Hers is a poor wounded name’ This supports The interpretation that Tess’ life was controlled by Fate the just like the events in the novel such as the horses death and the death of the pheasants which all acted as a sense of foreboding and events which pre determine Tess death. Towards the latter stages of the novel during chapter 46, Hardy again emphasises the significant role Fate has played in Tess’ life and misfortunes. Firstly at the bottom of page 320 Tess states†¦ â€Å"How can I pray for you?†¦ When I am forbidden to believe that the great power who moves the world would alter his plans on my account? † Tess is telling Alec that she has lost her belief in God as her prayers do not move him. Therefore she is indicating this is happening because God already has his plans made and what she wants makes no difference because she is not important enough for him to change them, thus empowering the element of Fate and it’s restrictions on her ability to change. Alice Walker, author of ‘The Colour Purple’ approaches the theme of Fate and destiny in a similar way to Hardy to a certain extent, in ‘The Colour Purple’ the character Celie goes through a series of events at the beginning of the novel, she is raped by her father on several occasions is forced to give away the children that she conceived through him then her sister Nettie is forced to leave the home in which Celie lives due to her Husband Mr†¦ , but later on in the novel we learn that Nettie is now living with the family that adopted her sister’s children. This shows that Alice Walker purposely portrayed Celie’s life as a victim of Fate, but gives her character an opportunity to resist this fate which results in a positive outcome for Celie. Its possible to say that Walker highlights the fact that although we may be victims of Fate we are able to control this Fate and our, she does this by showing that Celie is in fact not a victim of fate and unlike Tess her own actions are what allow her to change her destiny. We can say this because Celie confides in God through her letters, giving her hope and belief and she restrains herself from killing the man who has brought her pain and suffering, Mr†¦ , unlike Tess . Celies ability to change and prevent Fate from controlling her life is ultimately down to the letters she writes to God, she tells her sister Nettie†¦ â€Å"Long as I can spell G-o-d I got somebody along† She believes she is never alone or hopeless as long as she has God in her life, writing to God gives her hope, this hope is what helps her overcome the negative aspects of her Fatalistic path that seemed as though her life would be controlled by abusive males that would drive her to murder her husband just like Tess did. On the other hand Tess’ Fate is once again predetermined by Hardy in chapter 41 when she stumbles upon dying pheasents and puts them out of their misery by bringing their inevitable deaths to an end prematurely†¦ â€Å"Poor darlings-to suppose myself the most miserable being on earth in the sight o’ such misery as yours! † she exclaimed, her tears running down as she killed the birds tenderly. † This Fatalistic event represents Tess’ destiny as she to will die due to her neck breaking as she will later be hung, Hardy uses this sense of foreboding once again signifying the belief that her character is her Fate, she is unable to change this, nothing she does will alter it. Similarly but with a contrasting outcome, in Colour Purple Fate re-emerges as killin Mr†¦ begins to dawn on Celies mind. â€Å"How I’m gon keep from killing him†¦ Naw I think I feel better if I kill him, I say I feels sickish. Numb, now. † Mr†¦ has abused Celie to the extent that she contemplates killing him, at this stage of the book readers are likely to speculate whether Fate has chosen this path for Tess, is this her destiny? Will she have to emulate Tess’ action to end her misfortunes? Or will she be able to alter her Fate through her hope in God and rational actions? Although she doesn’t go on to murder Mr†¦ , through God and her companion Celie she finds the courage to speak up against Mr†¦ and leave him, ultimately changing her Fate which is something Tess was unable to do†¦ â€Å"You a low down dog is what’s wrong. It’s time to leave you and enter into the creation. And your dead body just the welcome mat I need. † Here Walker shows her strength and courage obtained through her hope in God. The authors use of foreboding throughout the novel can be seen as a representative of fate, Hardy believed that what happened to us was a product of our personality, class, status and the way in which we view life therefore Tess’ pride and her concern for Angels reputation after he leaves her prevents her from seeking help at an early stage of her troubles can be seen as her own actions but in Hardy’s view our own actions were down to fate , she ends up confiding in Alec which leads to disaster. From this we can question whether Tess’ actions lead to her downfall or was it Fate? This is demonstrated at the beginning of the final paragraph, hardy writes†¦ † ‘Justice’ was done, the president of immortals had ended his sport with Tess. † Hardy is telling us Fate has finished playing with its victim, Tess. He may have done this to further draw attention to his beliefs that we are subject to a immoral force beyond our control that we are forced to endure and that religion does not have bearing on any events in our life. This is a viewpoint that was developed by critic Irving Howe who too believed Tess’ fate had already been predetermined, Proposing this is why Hardy named the final phase of the novel ‘fulfilment’. Furthermore, another way Hardy depicts Tess as a victim of Fate is through the language he uses, particularly in the last phase of the novel as he named it ‘fulfilment’ thus this is a play on words as we are left to question what has been fulfilled. It is possible to say Hardy believed Fate had been fulfilled it had played it’s role in bringing Tess to her tragic downfall. Walker presents Celie as a victim of Fate like Hardy does Tess, however Walker stresses the point that we are able to change our Fate and destiny, this is significant as the colour purple which is the colour of the purple flowers represent spirituality & hope. She is almost trying to convey the message that, Fate can be overcome as long as hope is present, where as Hardy purposely doesn’t give Tess any chance of overcoming her Fate, he deliberately does this to assert his negative view on religion, Walker gives her character hope through God, this is what enables Celie to overcome her so called ‘Fate’ or ‘Destiny’ whilst Hardy’s pessimistic belief of religion deters him from doing this. Through his novels Hardy repeatedly articulated that chance and coincidence that bring about disaster are ultimately Fate, thus he empowers his belief through Tess that characters are subject to forces beyond their control. This is similar to another of his novels, ‘The Return of the Native. ‘ Throughout The Return of the Native bad things happen to good people, this is a depiction of his atheist perception that God does not exist and if there is a God it is lacking in morals, because good people, such as Tess are the victims of bad events and tragedy in life due to Fate. Like Hardy himself said†¦ ‘Once a victim, always a victim of fate. ‘

Since the dawn of mankind, man has been searching for the answer to just one question: Why do we dream? I believe strongly that the reason is not clear-cut and as easy to answer as it might seem. I think that dreams range in meaning and importance. When someone has a dream, there are many possible types of dreams they could have. First of these possibilities is for a dream that involves absolutely no meaning whatsoever. The dream is meaningless and involves a chain or series of events that are unrelated to one another and may be of people or places familiar or not. These dreams are most likely created because of the flash and mixture of chemicals that occurs during sleep. Many times these dreams are actually so bazaar that they have no meaning even to the dreamer. So these dreams are mostly just passed over and ignored. The second type of dream is one in which the dreamer can comprehend everything that is going on but things seem to have no meaning as before. But in some of these dre ams, there are symbols that come into play. When you look at these dreams sometimes they can represent real life events. Often these are predictions about what could happen in the future or are an interpretation of things that have passed. These, like almost all other dreams have significance as a result of bodily rejuvenation processes. This type of dream has a significance I believe in helping the person have the feeling of a good sleep, where things have, if not in some bazaar way, been resolved. The third type of dream is one which makes great and perfect sense to the dreamer but doesn’t have any real meaning. An example of this is dreaming that you are flying. Although you know what you are doing, and are comprehending this, it really doesn’t have meaning in your life. Dreams like this can be quite mentally satisfying to the dreamer. Many times a dream like this can be almost a form of entertainment to the dreamer, especially if the dreamer realizes they are dreaming. When this happens sometimes the dreamer will take control of their dream and can do things they would not normally be able to do in real life. Another type of dream is one where the dream has full meaning and the dreamer can fully reali ze everything that happens. Dreams like this can show exactly the way things could happen in the future, or ways of dealing with problems that will occur or have occurred. Many people believe that a dream of this kind could be an actual depiction of the way things will happen. Many people swear to this belief. I personally do believe in this possibility. Basically, I believe that people have not even begun to realize the potential of the human mind. I think that even with as much as we know about technology, it cannot even compare to the power and unlimited ability of the human mind. I believe that many times, our dreams can actually be predictions about the future. Also, I personally believe that the mind can actually solve problems while in a sleep state. I know that sometimes I have gone to sleep with a problem planted in my mind, and would awaken having dreamt of an answer. Many times this would help me to more clearly confront the problem and resolve it. I don’t really believe in any one of the theories about dreaming myself, but rather think that a mixture of all of them is true. What it comes down to is that dreaming is a chemical process that at the same time generates a side-effect that we call dreaming. But the brain itself actually will control this so that it sometimes has meaning to us. I believe that subconsciously we have areas of the brain that are in-tune to things beyond normal comprehension. These areas develop the real meaning of dreams and their significance in our lives.

Feasibility: Macro-market drivers PESTEL analysis Political environment The firm’s success will be subject to the prevailing political environment in Oman (Ghuman 2010). Therefore, the firm will be in a position to import the necessary food products such as meat, cereals, and milk products from the member states conveniently. Additionally, the firm’s operations will be facilitated by the WTO’s choice of Oman as the ideal hub for distributing goods in other parts of the GCC region (James 2014). Social environment A significant proportion of the Omani population is comprised of citizens aged between 1 to 54 years. This age group accounts for 92.9% of the total population (Alpen Capital 2014). This aspect shows that the country is characterised by a substantial market size that Shake Burgers can expl oit. Value is understood as the monetary gain associated with how well the supply (goods and services) meets the demand (user needs) in terms of efficiency, speed, and quality. Planning can be derived from arioso user sources such as customers, business owners, suppliers, employees, stakeholders, communities, and even whole nations. The objective of planning is to seize opportunities develop, fortify, and uphold competitive advantage. Planning sets the stage for project management (Bateman Snell, 2009). Leading Leading is a motivational position in management that involves close contact with people. Leading is predicated on communication with groups and individuals. Leading takes place in the smallest of teams to the largest of executive staff within an organization. Leading functions of a manager give employees motivation to come to ark, while the motivation of executives gives managers inspiration to do their Jobs. Leading gets others to contribute their ideas. Leading is to mobile people towards company objectives through guidance and inspiration (Bateman Snell, 2009). Delegation is a major portion of leading. Effective delegation frees the manager to focus on managerial tasks such as planning and control (Lorena, 2008, 1 2). My company effectively cultivates leading through regular meetings that encourage the thoughts of employees. Discussions are focused on in each meeting to give mattes the opportunity for commentary on process improvement. Controlling Controlling is a learning process that monitors tasks, encourages quality performance, and challenges change. In essence, controlling is quality assurance that organizational goals are being meet, safety guidelines are being followed, and company resources are being used effectively and efficiently. Controlling is ultimately about monitoring performance (Bateman Snell, 2009). In an article titled Pass It On! , the author states, We tend to have the mind-set that says, If you want it done right, do it yourself. After all, how else can we control quality? (Whitman, 2007, 1 2). Controlling is ultimately about quality assurance of execution. An effective manager must be able to entrust employees with the workload duties. My current employer has a quality assurance department which is solely dedicated to monitoring the work of employees through recorded telephone lines and regular paperwork audits. Early Life Manuel Luis Quezon y Molina was born on August 19, 1878, in Baler, now in Aurora Province. (The province is actually named after Quezons wife.) His parents were Spanish colonial army officer Lucio Quezon and primary school teacher Maria Dolores Molina. Of mixed Filipino and Spanish ancestry, in the racially segregated Spanish Philippines, the Quezon family were considered blancos or whites, which afforded them more freedom and higher social status than purely Filipino or Chinese people enjoyed. When Manuel was nine years old, his parents sent him to school in Manila, about 240 kilometers (150 miles) away from Baler. He would remain there through university; he studied law at the University of Santo Tomas  but did not graduate. In 1898, when Manuel was 20, his father and brother were accosted and murdered along the road from Nueva Ecija to Baler. The motive may have been simply robbery, but it is likely that they were targeted for their support of the colonial Spanish government against the Filipino nationalists in the independence struggle. Entry into Politics In 1899, after the US defeated Spain in the Spanish-American War and seized the Philippines, Manuel Quezon joined Emilio Aguinaldos guerrilla army in its fight against the Americans. He was accused a short time later of murdering an American prisoner of war, and was imprisoned for six months, but was cleared of the crime for lack of evidence. Despite all of that, Quezon soon began to rise in political prominence under the American regime. He passed the bar exam in 1903 and went to work as a surveyor and clerk.  In 1904, Quezon met a young Lieutenant Douglas MacArthur; the two would become close friends in the 1920s and 1930s. The newly-minted lawyer became a prosecutor in Mindoro in 1905  and then was elected governor of Tayabas the following year. In 1906, the same year he became governor, Manuel Quezon founded the Nacionalista Party with his friend Sergio Osmena. It would be the leading political party in the Philippines for years to come. The following year, he was elected to the inaugural Philippine Assembly, later renamed the House of Representatives. There, he chaired the appropriations committee and served as majority leader. Quezon moved to the United States for the first time in 1909, serving as one of two resident commissioners to the US House of Representatives. The Philippines commissioners could observe and lobby the US House  but were non-voting members. Quezon pressed his American counterparts to pass the Philippine Autonomy Act, which became law in 1916, the same year that he returned to Manila. Back in the Philippines, Quezon was elected to the Senate, where he would serve for the next 19 years until 1935. He was selected as the first President of the Senate  and continued in that role throughout his Senate career. In 1918, he married his first cousin, Aurora Aragon Quezon; the couple would have four children. Aurora would become famous for her commitment to humanitarian causes. Tragically, she and their eldest daughter were assassinated in 1949. Presidency In 1935, Manuel Quezon headed a Filipino delegation to the United States to witness US President Franklin Roosevelts signing of a new constitution for the Philippines, granting it semi-autonomous commonwealth status. Full independence was supposed to follow in 1946.   Quezon returned to Manila and won the first national presidential election in the Philippines as the Nacionalista Party candidate. He handily defeated Emilio Aguinaldo and Gregorio Aglipay, taking 68% of the vote.   As president, Quezon implemented a number of new policies for the country. He was very concerned with social justice, instituting a minimum wage, an eight-hour workday, the provision of public defenders for indigent defendants in court, and the redistribution of agricultural land to tenant farmers. He sponsored the building of new schools across the country, and promoted womens suffrage; as a result, women got the vote in 1937. President Quezon also established Tagalog as the national language of the Philippines, alongside English. Meanwhile, however, the Japanese had invaded China in 1937 and started the Second Sino-Japanese War, which would lead to World War II in Asia. President Quezon kept a wary eye on Japan, which seemed likely to target the Philippines soon in its expansionist mood. He also opened the Philippines to Jewish refugees from Europe, who were fleeing increasing Nazi oppression in the period between 1937 and 1941. This saved about 2,500 people from the Holocaust. Although Quezons old friend, now-General Douglas MacArthur, was assembling a defense force for the Philippines, Quezon decided to visit Tokyo in June of 1938. While there, he tried to negotiate a secret mutual non-aggression pact with the Japanese Empire. MacArthur learned of Quezons unsuccessful negotiation, and relations temporarily soured between the two. In 1941, a national plebiscite amended the constitution to allow presidents to serve two four-year terms rather than a single six-year term. As a result, President Quezon was able to run for re-election. He won the November  1941 poll with almost 82% of the vote over Senator Juan Sumulong. World War II On December 8, 1941, the day after Japan attacked Pearl Harbor, Hawaii, Japanese forces invaded the Philippines.  President Quezon and other top government officials had to evacuate to Corregidor along with General MacArthur.  He fled the island in a submarine, moving on to Mindanao, then Australia, and finally the United States.  Quezon set up a government in exile in Washington D.C.   During his exile, Manuel Quezon lobbied the US Congress to send American troops back into the Philippines.  He exhorted them to Remember Bataan, in reference to the infamous Bataan Death March.  However, the Filipino president did not survive to see his old friend, General MacArthur, make good on his promise to return to the Philippines. President Quezon suffered from tuberculosis.  During his years in exile in the US, his condition steadily worsened until he was forced to move to a cure cottage in Saranac Lake, New York.  He died there on August 1, 1944.  Manuel Quezon was originally buried in Arlington National Cemetery, but his remains were moved to Manila after the war was over.

Her father, John, has primary guardianship in Quebec. During the school breaks and holiday vacations, she lives with her mother, Anne, in New York. John is a high-level government minister, working on creating an independent French Canadian State. Under Canadian law, both Anne and John retained full custodial and parental rights following the divorce. Six months ago, Jane was living in New York during a school break. During the break, Jane telephoned her father asking to be allowed to return to Quebec. John advised her to stay the remainder of the break and try to get along with her mother. Two days later, at 6:00pm, Anne returned from work to find a message on her answering machine from Jane, saying that she was going to live with her uncle, Billy, in California. He is 21 years old. Jane claims that other rebellious children and adults who disagree with the goals of the government have been used for propaganda purposes Application The issue of asylum is not always easy and special notes are particularly made for asylum when it seekers involve minors. The United Nations General Assembly recognized and accepted international instruments and documents that contain provisions specifically relating to children. They recognize and promote the principle that childrens rights are human rights, and that childrens rights are universal. See, Universal Declaration of Human Rights, (1948)(e.g., Article 14 provides for the right to apply for asylum, Article 25(2) refers to the special care and assistance required for children). Pursuant to 8 U.S.C 12  §1158 (2004), any foreigner physically in the United States, irrespective of such alien’s status, may apply for asylum. The Secretary of Homeland Security or the Attorney General may grant asylum to any who have filed for asylum and has completed the requirements and followed the required procedures, Id.  § 1158(b) (1) (a). The next part of the issue is who can file for the minor. Jane would be classified as either a minor principal or an unaccompanied minor according to U.S. Citizenship and Immigration Services. The difference between the two is a minor principal is a person under the age of 18 when filing for asylum by one’s own right, as opposed to as a derivative family member on a parent’s or spouse’s asylum application. An unaccompanied minor principal applicant for asylum who is under 18 years of age and who has no parent or legal guardian in the U.S. who is available to provide care and physical custody. This definition encompasses separated minors, e.g., those who are separated from their parents or guardians, but who are in the informal care and physical custody of other adults, including family members. See, Homeland Security Act 6 U.S.C.  §279 (2002). The latter is better fitting in Jane’s case. Because she is under the age of 18, she left the care of her parent, has no living parent in the United States, and in the physical care of an adult family member. The last part of issue one is the filing an application for asylum be a child. .In Gonzalez v. Reno, 86 F. Supp. 2d 1167 (S.D. Fla. 2000), aff’d, the court found that a child with out mental capacity cannot file asylum against the wishes of parent. In Polovchak, the court concluded the minimum age of 12 was the lowest for the age of majority needed to distinguish the child’s asylum interests that different from those of their parents. Polovchak v. Meese, 774 F.2d 731 (7th Cir. 1985). Jane has a particular fear of being used, as propaganda, in a province political issue will not affect her age to form a political opinion. Six-year-old Cuban national Elian Gonzalez became the focus of international attention five months ago, on November 25, 1999, when he was rescued by two Miami anglers who found him floating on an inner tube several miles off Fort Lauderdale. Elian was transferred to a United States Coast Guard vessel so he could be transported to a nearby hospital for treatment for dehydration and hypothermia. Elians mother, Elisabeth Brotons, drowned during the voyage from Cuba. The INS temporarily paroled him into the care of Lazaro Gonzalez, his great uncle, in Miami. On January 19, 2000, Lazaro Gonzalez, instituted this action as next friend, or alternatively as interim temporary legal custodian, of Elian Gonzalez, a six-year-old child, against the Attorney General, the Commissioner of the Immigration and Naturalization Service (INS), and other federal defendants. The complaint challenged the INSs refusal to accept and adjudicate two asylum applications that Lazaro submitted with respect to Elian and an essentially identical application that bore Elian’s signature. On January 27, 2000, the government filed a motion to dismiss or, in the alternative, for summary judgment. The district court heard oral argument on the governments motion on March 9, 2000. On March 21, 2000, the district court granted the governments motion to dismiss or for summary judgment and dismissed the case. Plaintiff appealed. On April 19, 2000, this Court issued an injunction pending appeal, barring Elians removal from the United States during the pendency of this app eal ISSUE: 1. Whether the district court was correct in holding that Elian Gonzalez has no due process rights concerning the manner in which the INS considered the asylum applications filed on his behalf. 2. Whether the INSs thoroughly considered and crafted approach to considering asylum applications submitted by a third party on behalf of a six-year-old child, against the express wishes of the childs sole surviving parent. RULE: 1. An unadmitted alien cannot challenge decisions by INS officials with regard to their applications for admission, asylum, or parole on constitutional grounds 2. An application for asylum cannot be made against the wishes of a parent, if the child lacks the mental capacity to request asylum and a third person cannot speak on the behalf of a minor because it is the right of the parent to speak on behalf of his child in the court. ANALYSIS: The Court felt that the district court ruled correctly on its holding that Elian Gonzalez had no due process rights in the way the Attorney General considered the asylum applications submitted for him. The ruling on due process was found to lack merit because aliens seeking admission to the United States . . . have no constitutional rights with regard to their applications, Jean v. Nelson, 727 F.2d 957, 968 (11th Cir. 1984). Although the statute requires the existence of some application procedure so that aliens may apply for asylum, section 1158 says nothing about the particulars of that procedure, 8 U.S.C.  § 1158. The matter for decision is not up for the courts to decide but for the agency to enforcing the statute, in this case the INS, to choose how to fill such gaps. See Chevron, U.S.A., Inc. v. Natural Resources Defense Council, Inc., 467 U.S. 837 (1984), 104 S. Ct. at 2793 The second issue was who could actually speak for Elian Gonzalez. The INS Commissioner reached a decision that a six year old is too young to file an asylum claim on his own. It was therefore the job of the Attorney General Reno’s job to determine who should speak for the child, and she found that the father, Juan Miguel, should speak for the child. In Polovchak v. Meese, 774 F.2d 731 (7th Cir. 1985, the court concluded the minimum age of 12 was the lowest for the age of majority needed to distinguish the child’s asylum interests that different from those of their parents. Lazaro Gonzalez application for guardianship was not allowed because the matter was with immigration lending it to be a federal matter. CONCLUSION: The courts ruled that an alien seeking asylum has no constitutional right to do so, thus removing the power to assert a right to due process under the law. Since Elian was an alien, the Attorney General had full custody over his status. On the second point was could Elian through a third party bring an application for asylum on his behalf. Because Elian was only six years old, he lacked the legal capacity to file for himself. The court felt that only the father could speak for his child. Since the application for asylum was in direct conflict with his wishes, the court saw no reason to reverse the lower court decision therefore sending the child back to his homeland.
